§416.11(b)(6): Tuberculosis test for caregivers
The first medical statement for providers, assistants and substitutes must include the results of a tuberculin test taken within the 12 months before the application. After that, a test is only required at the discretion of the person's health care provider or when the person starts work at a different child care program. The citation concerns that statement. It does not say anyone tested positive.

The state's wording
The initial medical statement for providers, assistants, and substitutes must include the results of a Mantoux tuberculin test or other federally approved tuberculin test performed within the 12 months preceding the date of the application. Thereafter, tuberculin tests are only required at the discretion of the employee's health care provider or at the start of new employment in a different child
This is the text the state (OCFS) attaches to the citation. It is a template, so it can sound harsher or vaguer than the finding behind it.
Worth asking the provider
Is each caregiver's medical statement on file?
Reading it on a record
Look at whether the citation is marked open or corrected, how long ago it was cited, and whether the same section shows up on several inspections. One corrected citation is common. The same one on visit after visit is worth a direct question. Our guide to checking a daycare and methodology explain the rest.

Counts are from the inspection records we hold, as of 2026-10-19. The plain-English note was written by NYC Daycare Check from the city's wording; the citation on each provider's page is the record.
