These Terms of Use ("Terms") govern your access to and use of the NYC Daycare Check website and related services (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What NYC Daycare Check is

NYC Daycare Check is an independent, informational guide that collects, organizes, and republishes publicly available government records about New York City childcare providers — including inspection and violation records published by the NYC Department of Health and Mental Hygiene (DOHMH), licensing and enforcement records published by the New York State Office of Children and Family Services (OCFS), and supporting public building, housing, and safety datasets. We present these records and our plainly-labeled summaries of them. We are not a government agency and are not affiliated with the City of New York or New York State.

2. Informational use only — no warranty

The Service is provided for general informational purposes only and on an "as is" and "as available" basis, without warranties of any kind, express or implied, including accuracy, completeness, timeliness, fitness for a particular purpose, or non-infringement. Government records may contain errors, may be incomplete, and may change after we collect them. Each record carries a "data as of" date; the authoritative, current record is the one held by the issuing agency. You should independently verify any information — including a provider's license status and inspection history — directly with DOHMH and OCFS, and visit a provider in person, before making any decision. Nothing on the Service is professional, legal, medical, or childcare advice.

3. No endorsement or rating

NYC Daycare Check does not endorse, recommend, certify, or assign its own "safety score" to any provider. Our summaries (such as the colored "record band") are mechanical descriptions of the government's own published determinations, computed by a fixed, disclosed rule (see our Methodology). They are not a judgment about the quality or safety of any named business.

4. Provider records & corrections

If you operate a childcare provider listed on the Service and believe a record is inaccurate, mismatched, or out of date, you may request a correction or removal through our Corrections process. We will review good-faith requests promptly. Verified operators may also publish a response that appears alongside their record; we do not alter the underlying government record.

5. Acceptable use

You agree not to: (a) use the Service to harass, threaten, or defame any provider, staff member, or family; (b) scrape, bulk-download, or resell the Service's data except as permitted by law; (c) misrepresent the data (for example, presenting an out-of-date record as current); (d) interfere with or attempt to breach the security of the Service; or (e) use the Service for any unlawful purpose.

6. Paid features

Reading government records is free. Optional paid features are the analysis we produce on top of those records: the "Safety Analysis" report, sold singly or as a three-report pack, and the provider "Verified Operator Tools" subscription. Pack unlocks not assigned to a center at purchase remain on your account until you use them; they do not expire and nothing renews. All purchases are billed through our payment processor, Stripe, and prices are disclosed at the point of purchase. We do not store your full payment card details.

Because a delivered report is digital content you can read and save immediately, report sales are final once the report has been delivered to your account. If a purchase goes wrong (for example a duplicate charge, an unlock applied to the wrong center, a report that fails to load, or a similar error), contact us within 7 days and we will correct the problem or refund the purchase. Provider subscriptions renew monthly and can be canceled at any time; cancellation stops future charges.

7. Limitation of liability

To the maximum extent permitted by law, NYC Daycare Check and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on information obtained through the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100.

8. Indemnification

You agree to indemnify and hold harmless NYC Daycare Check and its operators from claims arising out of your misuse of the Service or violation of these Terms.

9. Changes

We may update these Terms; material changes will be reflected by the "last updated" date above. Continued use after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles, and any dispute relating to the Service will be brought exclusively in the state or federal courts located in New York. The Service is operated by NYC Daycare Check ("we," "us"). If you later register a business name or form an entity (e.g. an LLC), name it here.
